The Federal Motor Carrier Regulations are rules that all truck drivers must follow. Section 392.3, Title 49 of the Federal Motor Carrier Regulations provides, in pertinent part, that a truck driver shall not drive a truck when his "alertness" is affected by being sick, fatigue or any other reason.
At our law offices, we frequently see truck drivers causing wrecks due to their being tired. Quite frequently, trucking companies force them to drive over the number of hours allowed under the law and as a result, it causes an accident.
